Thank you for your interest in my work! Please read through and understand the ToS before purchasing. These are the terms you agree to when you purchase/own one of my adoptables/character designs. These terms are subject to change without notice, so please check back. This applies to every adoptable I have created (regardless if it was obtained in a sale, resale, trade, or received as a gift).I reserve the right to refuse or cancel and refund a commission for any reason.I will not create a design based off another person’s design or species without permission from the original creator and current owner.PAYMENTS
Payment must be received within 48 hours of invoice or the commission may be cancelled.Payment must be received in full before I will start your request.REVISIONS
Revisions are provided free of charge at the sketch stage, and minor revisions are provided at the lining and color stage (less than 1/4th of the drawing). Major revisions (more than 1/4th of the drawing past the sketch phase) will require additional payment. Please be open and precise regarding changes during the sketch phase. Above all, I want you to be satisfied with and able to use the completed artwork, so please don’t be shy about your requests.DEADLINES AND DELIVERY
You will receive the un-watermarked adoptable artwork in high resolution within 1-2 months unless otherwise specified.USE
Do not copy, heavily reference, or claim my designs as your own.You must credit me (shuufly) as the creator of the design upon first sharing my artwork on any site or offline and when asked.You must credit me (shuufly) as the creator of the design upon first sharing your artwork or commissioned artwork of the design on any site or offline and when asked.You must credit the original artwork to me.Edits to the design are allowed, but do not edit my artwork without permission.Twins/copies of the design are not allowed unless they stay together and keep the same combined value.Species/closed species or my original concepts may not be used without permission for other designs or writing.Gifting, trading, reselling, or vouchering the design for the same value as when first purchased is allowed. Please notify me of transfer of ownership.The design may be sold or vouchered for more than its initial cost if additional artwork and/or writing/development is included, or if you deem it necessary due to emotional attachment. Please do not abuse this privilege. This does not include commercial usage (profiting off the design by using it in a product or service), which is prohibited unless commercial usage has been negotiated beforehand.If you have any questions or aren’t sure, please contact Shuufly (info below).INTELLECTUAL PROPERTY RIGHTS
I, the artist, retain full and exclusive rights to the original artwork and design. The client may not claim it as their own or use it for anything other than personal use unless they have paid for commercial usage and have my written permission. Redistribution of my artwork for use in printed merchandise or as promotion of goods, services or social media pages is prohibited unless commercial usage has been negotiated and paid for. If you have any questions about this, ask me before commissioning me.I will never use the design commercially or for personal use unless the design was reclaimed for a violation of my ToS.Conditions for RepostingThe client has my permission to repost the artwork wherever they would like, as long as proper credit is given and my watermark/signature remains intact and unaltered.The client should not post the unwatermarked image anywhere publicly to prevent theft.Prohibited ActionsAltering my artwork in any way without asking for permission beforehand, with the exception of cropping/resizing the image for an icon or other use.Using my artwork as references for your own, whether tracing or re-purposing parts of the image.Claiming the artwork or design as your own.Using the artwork or design for AI or NFT purposes.REFUNDS
No refunds will be given once the commission has begun, except on a case by case basis. If the commission is past the sketch phase and a refund is given, I reserve the right to use or sell the design.COMMUNICATION
